Marianne T. O’Toole practices primarily in the areas of litigation, bankruptcy,  creditor’s rights, and other insolvency matters. In addition,  Ms. O’Toole offers legal counsel with respect to commercial real estate finance and securitization transactions.

From 1993 to 2002, Ms. O'Toole served as an Assistant United States Attorney for the Southern District of New York.  During her tenure with the United States Attorney's Office, Ms. O'Toole represented the United States and its agencies in all phases of civil litigation, including trials and appeals in both federal and state court.  She was responsible for a range of cases involving commercial law, tax, bankruptcy, fair housing, employment law, constitutional law, environmental law, and tort law.  Between 2000 and 2002, Ms. O'Toole served as Chief of the Tax and Bankruptcy Unit within the Civil Division of the United States Attorney's Office for the Southern District of New York.  In that capacity, she supervised and handled hundreds of bankruptcy cases on behalf of the United States of America and its agency in the United States Bankruptcy Court for the Southern District of New York. In 2000 and 2001, Ms. O'Toole was selected as a member of the Strategic Planning Committee of the United States Bankruptcy Court for the Southern District of New York.



Prior to joining the United States Attorney's Office, Ms. O'Toole was a law clerk to the Honorable Charles L. Brieant, then Chief Judge for the United States District Court for the Southern District of New York.  Ms. O'Toole has practiced law in New York since 1989 when she was an associate in the New York office of an AM Law 100 Firm.

 

Ms. O’Toole received her J.D. in 1989 from Pace University School of Law, where she was Managing Editor of the Law Review. Ms. O’Toole is a member of the NYS Bar Association, the New York City Bar, the DC Bar Association, the National Association of Bankruptcy Trustees, and the American Bankruptcy Institute.

 

Ms. O’Toole serves as a standing member of the panel of United States Bankruptcy Trustees for Southern District of New York. As a member of the trustee panel, she is appointed to operate, reorganize and/or liquidate business concerns and individual bankruptcy estates under both Chapter 11 and Chapter 7 of the United States Bankruptcy Code. She has served as a post-confirmation Plan Administrator and/or Distribution Agent in several Chapter 11 cases in Manhattan. Ms. O’Toole has also been appointed as a Special Master in Multi District Litigation, as well as a guardian ad litem in shareholder derivative litigation.
